Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and tinytag Inc. ("tinytag," "we," "us," or "our"), a Delaware corporation. They govern your access to and use of tinytag.com, our online store, and any related sites or services we operate (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 16 years old, or the age of majority in your jurisdiction (whichever is older), to use the Site. By using the Site you represent and warrant that you meet this requirement and that you are using the Site for your personal, non-commercial purposes unless we have separately agreed in writing.

2. The Service; Orders and Payment

tinytag operates an online store where you can design and purchase personalized, made-to-order name labels. Product descriptions, pack contents, and prices are shown on the Site and are stated in U.S. dollars. We may add, change, suspend, or remove products and features, and may correct pricing or description errors, at any time without notice.

When you place an order, you submit an offer to purchase. Payment is processed by our third-party payment processor (Stripe); we do not receive or store your full payment-card details. Your order is accepted, and a contract is formed, only when we send you an order confirmation. We may decline or cancel an order (for example, due to a pricing error, suspected fraud, or content that violates these Terms), in which case we will refund any amount charged.

Because every label pack is custom-printed with the name and any photo you provide, orders generally cannot be changed or cancelled once production begins. Please review your personalization carefully before checkout. Returns, reprints, and refunds are governed by our Returns Policy, which forms part of these Terms. We print and ship within the timeframes described on the Site; delivery times are estimates and are not guaranteed.

By uploading a photo or other content to personalize your labels, you represent that you have the right to use it, that doing so does not infringe anyone's rights, and that any person depicted (or, where that person is a child, their parent or legal guardian) has consented to its use to fulfill your order. We use uploaded content solely to produce and ship your order, as described in our Privacy Policy.

3. Signups and Communications

If you provide your email address through our signup form, you consent to receive occasional updates about new releases, restocks, and promotional offers from tinytag. These marketing messages are separate from the transactional messages about your orders, which you receive as part of your purchase. You may unsubscribe from marketing messages at any time using the link in our emails or by submitting a request through our contact form.

5. Intellectual Property

The Site and all of its content-including text, graphics, logos, images, illustrations, videos, software, and the "tinytag" name and marks-are owned by tinytag Inc. or its licensors and are protected by United States and international copyright, trademark, and other intellectual-property laws. Except for the limited right to view the Site for your personal, non-commercial use, no license or right is granted to you. You may not copy, reproduce, distribute, publicly display, publicly perform, modify, or create derivative works of any part of the Site without our prior written permission.

6. Feedback

If you send us suggestions, ideas, or other feedback about the Site or our planned products, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and exploit that feedback for any purpose, without obligation or compensation to you.

7. Third-Party Services

The Site may link to or integrate with third-party services (for example, WhatsApp for messaging). We are not responsible for the availability, content, or practices of those services. Your use of any third-party service is governed by that service's own terms and privacy policy.

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTAG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON THE SITE WILL BE ACCURATE, COMPLETE, OR TIMELY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTAG INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

10. Indemnification

You agree to defend, indemnify, and hold harmless tinytag Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to these Terms or the Site, are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. Subject to Section 12, you and tinytag agree that the state and federal courts located in the State of Delaware will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Site, and you consent to personal jurisdiction in those courts.

12. Informal Dispute Resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by sending a written description of the dispute and your contact information through our contact form. The parties will use good-faith efforts to resolve the dispute for at least sixty (60) days before initiating any legal proceeding.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the effective date above. Your continued use of the Site after the changes take effect constitutes your acceptance of the updated Terms.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and tinytag Inc. regarding the Site, and supersede any prior agreements. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms freely.
